Let's Go Paddle is an online platform designed to help paddlers discover, save, track, and share kayaking, canoeing, paddleboarding, and other paddling launch locations and experiences.

The Service may also allow users to:

• Discover paddling launch locations
• View launch information and maps
• Save or track launch locations
• Record places they have paddled
• Share photographs and paddling experiences
• Create posts and comments
• Connect with other paddlers
• Create or join group paddling trips
• Share reviews or information about launch locations
• Communicate and interact with other users
• Access other paddling-related information and features

Let's Go Paddle is an information and social networking platform.

Unless expressly stated otherwise, Let's Go Paddle is not a professional outfitter, paddling guide, tour operator, transportation provider, rescue service, navigation service, weather service, water-safety authority, or emergency service.

By using the Service, you represent that you have read, understood, and agree to these Terms.

If you create an account, you may be required to affirmatively acknowledge your agreement to these Terms.

Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect information.

The Privacy Policy is incorporated into these Terms by reference where applicable.

You must be legally capable of entering into these Terms to create and maintain an account.

Let's Go Paddle is not directed to children under 13 years of age.

Users under the age of majority in their jurisdiction should use paddling and outdoor activities only with appropriate parental, guardian, or adult supervision.

Parents and guardians are responsible for determining whether Let's Go Paddle and any paddling activity are appropriate for minors under their supervision.

Certain features may require an account.

When creating or maintaining an account, you agree to provide reasonably accurate information and to keep applicable account information current.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• Activities conducted through your account
• Protecting access to your device
• Promptly notifying us if you believe your account has been compromised

You may not:

• Impersonate another person
• Create an account using another person's identity without authorization
• Misrepresent your identity for fraudulent or harmful purposes
• Access another user's account without permission
• Use automated means to create fraudulent accounts
• Circumvent account restrictions or suspensions

We may suspend, restrict, or terminate accounts that violate these Terms or pose a risk to other users or the Service.

Paddling Involves Inherent Risk

Kayaking, canoeing, paddleboarding, boating, swimming, and other water-related and outdoor activities involve inherent and potentially serious risks.

These risks may include, without limitation:

• Drowning
• Capsizing
• Falling into the water
• Hypothermia
• Heat-related illness
• Severe weather
• Lightning
• High winds
• Strong currents
• Tides
• Waves
• Rapids
• Flooding
• Rapidly changing water levels
• Submerged objects
• Rocks
• Trees and strainers
• Dams
• Spillways
• Boat traffic
• Wildlife
• Dangerous plants
• Poor water quality
• Remote locations
• Difficult terrain
• Limited cellular service
• Inadequate emergency access
• Equipment failure
• Collision
• Injury
• Illness
• Property damage
• Serious bodily injury
• Death

YOU VOLUNTARILY ASSUME THE RISKS ASSOCIATED WITH PADDLING AND OTHER OUTDOOR ACTIVITIES.

Let's Go Paddle cannot determine whether any launch, waterway, route, weather condition, trip, activity, or location is safe for you.

Before participating in any paddling activity, you are responsible for evaluating:

• Your own skill level
• Your physical condition
• Your swimming ability
• Your paddling experience
• Your equipment
• Your personal flotation device and other safety equipment
• Weather conditions
• Water conditions
• Water levels
• Current
• Tides
• Wind
• Temperature
• Daylight
• Boat traffic
• Local hazards
• Access conditions
• Applicable laws and regulations
• Whether the activity is appropriate for you

Information appearing on Let's Go Paddle is not a substitute for personal judgment, proper training, appropriate equipment, local knowledge, official advisories, or professional guidance.

You should independently evaluate conditions before entering the water.

Let's Go Paddle strongly encourages users to use properly fitted, appropriate personal flotation devices and safety equipment and to comply with all applicable boating and water-safety laws.

The equipment appropriate for a particular paddling activity depends on factors including the waterway, weather, temperature, distance, paddler experience, and type of craft.

You are solely responsible for selecting and using appropriate safety equipment.

Let's Go Paddle attempts to provide useful information about paddling launch locations.

However, launch information may come from:

• Publicly available information
• Third-party sources
• Maps
• Government information
• User submissions
• Personal observations
• Other sources

Conditions can change without notice.

A launch listed on Let's Go Paddle may:

• Be closed
• Be temporarily inaccessible
• Be damaged
• Be flooded
• Be affected by drought
• Require a permit
• Require payment
• Have changed operating hours
• Have parking restrictions
• Have vehicle restrictions
• Have seasonal restrictions
• Be subject to construction
• Become private property
• Have changed ownership
• Be unsafe
• Have inaccurate coordinates
• Have different facilities than those described
• No longer exist

LET'S GO PADDLE DOES NOT GUARANTEE THAT ANY LAUNCH INFORMATION IS COMPLETE, ACCURATE, CURRENT, ACCESSIBLE, LEGAL TO USE, OR SAFE.

Always verify important information independently before traveling to or using a launch.

The presence of a location on Let's Go Paddle does not mean that the public has a legal right to enter or use the property.

Property ownership, access rights, easements, launch permissions, and water-access laws may change or may be difficult to determine.

You are responsible for determining whether you have legal permission to:

• Enter property
• Park
• Launch
• Take out
• Cross property
• Access a waterway
• Use facilities

Never trespass.

Obey posted signs, gates, closures, property restrictions, laws, and lawful instructions from property owners or government authorities.

Let's Go Paddle may provide maps, coordinates, directions, distances, or links to third-party mapping services.

These features are provided for informational and convenience purposes.

Mapping information can contain errors.

GPS coordinates can be inaccurate.

Roads may be closed.

Routes may cross private property.

Water routes may contain hazards not shown on a map.

DO NOT RELY ON LET'S GO PADDLE AS YOUR SOLE NAVIGATION RESOURCE.

Users traveling in remote areas should carry appropriate navigation and emergency equipment and should independently verify routes and conditions.

Let's Go Paddle does not guarantee current weather, water levels, river flow, tides, currents, water temperature, flood conditions, or other environmental information.

Conditions can change rapidly.

Before paddling, users should consult appropriate authoritative sources such as:

• National Weather Service
• NOAA
• U.S. Geological Survey
• U.S. Coast Guard
• Local emergency-management agencies
• State wildlife or natural-resource agencies
• Park authorities
• Water-management agencies
• Other appropriate official sources

The absence of a warning on Let's Go Paddle does not mean conditions are safe.

LET'S GO PADDLE IS NOT AN EMERGENCY SERVICE.

Do not use Let's Go Paddle to request emergency assistance.

If you or someone else is experiencing an emergency, contact 911 or the appropriate local emergency service.

Do not assume that another user, trip participant, group organizer, or Let's Go Paddle will monitor your location or know that you need assistance.

Let's Go Paddle may allow users to create, advertise, organize, join, or discuss group paddling trips.

Unless Let's Go Paddle expressly states otherwise in writing, trips created through the Service are user-organized activities.

Let's Go Paddle does not become the organizer, operator, guide, outfitter, supervisor, safety officer, transportation provider, or sponsor of a trip merely because the trip was created, advertised, discussed, or coordinated using the Service.

Let's Go Paddle does not necessarily:

• Screen trip organizers
• Verify paddling experience
• Verify certifications
• Inspect equipment
• Evaluate waterways
• Evaluate weather
• Determine appropriate skill levels
• Conduct safety briefings
• Provide rescue services
• Provide insurance
• Supervise participants
• Verify transportation arrangements

Participation in a user-organized trip is voluntary and at your own risk.

Users who create group trips are responsible for accurately representing the nature of the trip to the best of their knowledge.

Creating a trip on Let's Go Paddle does not make the organizer an employee, agent, contractor, representative, or partner of Let's Go Paddle.

Let's Go Paddle does not endorse an organizer merely because the organizer is permitted to create a trip.

Trip organizers should clearly communicate relevant information such as:

• Expected skill level
• Approximate distance
• Expected duration
• Known hazards
• Meeting location
• Equipment expectations
• Take-out arrangements
• Shuttle arrangements

However, users remain responsible for independently determining whether participation is appropriate.

Before joining a group trip, you should independently evaluate:

• The organizer
• Other participants
• Your abilities
• The difficulty of the trip
• The waterway
• Weather
• Water conditions
• Required equipment
• Transportation
• Emergency planning

Participation in a group does not guarantee your safety.

Do not assume that another participant is qualified to rescue you or provide medical assistance.

Let's Go Paddle contains social features that may allow users to meet, communicate, or paddle together.

We do not guarantee the identity, background, qualifications, experience, intentions, reliability, or conduct of users.

You are responsible for exercising reasonable judgment when interacting with people you meet through the Service.

When meeting another user for the first time, consider appropriate personal-safety precautions.

Let's Go Paddle is not responsible for the conduct of users outside the Service.

Users may be permitted to submit content including:

• Posts
• Comments
• Photographs
• Reviews
• Launch information
• Trip information
• Profile information
• Messages
• Corrections
• Recommendations
• Other materials

Collectively, this is referred to as "User Content."

You retain ownership of User Content you own.

By submitting User Content to Let's Go Paddle, you grant Let's Go Paddle a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, resize, format, adapt for technical purposes, and otherwise use that content as reasonably necessary to operate, promote, maintain, and improve the Service.

This license does not transfer ownership of your User Content to Let's Go Paddle.

You represent that you have the rights necessary to submit the User Content and grant this license.

You may only upload photographs that you have the legal right to share.

Do not upload photographs in violation of another person's:

• Copyright
• Privacy rights
• Publicity rights
• Contractual rights
• Other legal rights

Users should exercise care when posting photographs showing:

• Children
• Private property
• Vehicle license plates
• Home addresses
• Sensitive locations
• Other identifying information

Let's Go Paddle may remove photographs that violate these Terms or applicable law.

Users may share opinions, reviews, and experiences concerning launch locations and paddling destinations.

Users are encouraged to provide honest, accurate, and respectful reviews based on their genuine experiences.

Let's Go Paddle does not require users to provide positive reviews.

Users may express legitimate negative opinions.

However, users may not knowingly post:

• False factual allegations
• Fraudulent reviews
• Reviews of places they falsely claim to have visited
• Threats
• Harassment
• Unlawful content
• Content intended to impersonate another person

Opinions expressed by users belong to those users and do not necessarily represent the views of Let's Go Paddle.

You may not use Let's Go Paddle to:

• Violate applicable law
• Threaten or harass another person
• Stalk another user
• Promote violence
• Commit fraud
• Impersonate another person
• Distribute malware
• Attempt unauthorized access to accounts or systems
• Interfere with operation of the Service
• Spam users
• Scrape the Service in violation of applicable restrictions
• Collect personal information for improper purposes
• Post knowingly false launch information
• Encourage trespassing
• Facilitate illegal activity
• Infringe intellectual-property rights
• Upload unlawful material
• Exploit minors
• Circumvent security measures
• Manipulate reviews or engagement
• Use automated accounts for abusive purposes

We may investigate suspected violations and take appropriate action.

Let's Go Paddle reserves the right, but does not undertake a general obligation, to monitor, review, restrict, remove, or disable access to User Content when reasonably necessary.

Content may be removed for reasons including:

• Violation of these Terms
• Safety concerns
• Fraud
• Spam
• Harassment
• Intellectual-property complaints
• Privacy concerns
• Illegal content
• Inaccurate or misleading launch information
• Technical reasons

The fact that content remains available does not mean Let's Go Paddle endorses or verifies it.

Users may report content, accounts, launch information, or behavior they believe violates these Terms.

We may investigate reports at our discretion.

Submitting a report does not guarantee that content will be removed or that an account will be suspended.

Knowingly submitting fraudulent or abusive reports may itself violate these Terms.

Except for User Content and third-party materials, Let's Go Paddle and its associated content, branding, software, design, graphics, databases, organization, and original materials are owned by or licensed to Let's Go Paddle and are protected by applicable intellectual-property laws.

The Let's Go Paddle name, logos, branding, and associated marks may not be used in a manner that falsely suggests endorsement, sponsorship, affiliation, or authorization.

Nothing in these Terms transfers ownership of Let's Go Paddle intellectual property to users.

If you believe content appearing on Let's Go Paddle infringes your copyright, please contact us with sufficient information to identify:

• The copyrighted work
• The allegedly infringing material
• Where the material appears
• Your contact information
• The basis for your claim

We may remove or restrict access to allegedly infringing content when appropriate.

Let's Go Paddle may integrate with or link to third-party services, including:

• Mapping services
• Navigation services
• Social-media platforms
• Authentication providers
• Weather services
• Government websites
• External websites

Third-party services are governed by their own terms and privacy policies.

Let's Go Paddle does not control and is not responsible for third-party services.

A link does not necessarily constitute endorsement.

Your privacy is important to us.

Our collection and use of personal information are described in the Let's Go Paddle Privacy Policy.

By using the Service, you acknowledge that you have been provided access to the Privacy Policy.

You may stop using Let's Go Paddle at any time.

Where available, you may request deletion of your account as described in our Privacy Policy.

Let's Go Paddle may suspend, restrict, or terminate an account if we reasonably believe:

• These Terms have been violated
• The account presents a security risk
• The account is being used fraudulently
• The user is threatening or harassing others
• Continued access could harm users or the Service
• Termination is required by law

Termination may result in loss of access to content or features associated with your account.

We do not guarantee that Let's Go Paddle will always be available.

The Service may be interrupted because of:

• Maintenance
• Updates
• Technical problems
• Internet outages
• Hosting failures
• Security incidents
• Third-party failures
• Events outside our control

Features may be added, changed, suspended, or discontinued.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LET'S GO PADDLE AND THE SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE."

WE MAKE NO WARRANTY THAT:

• THE SERVICE WILL ALWAYS BE AVAILABLE
• INFORMATION WILL ALWAYS BE ACCURATE
• LAUNCHES WILL BE ACCESSIBLE
• WATERWAYS WILL BE SAFE
• MAP INFORMATION WILL BE CORRECT
• USER INFORMATION WILL BE ACCURATE
• GROUP TRIPS WILL BE SAFE
• USERS WILL BE TRUSTWORTHY
• THE SERVICE WILL BE ERROR-FREE

YOU USE THE SERVICE AT YOUR OWN DISCRETION AND RISK.

Nothing in these Terms excludes warranties that cannot legally be excluded.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LET'S GO PADDLE AND ITS OWNERS, OPERATORS, AFFILIATES, SERVICE PROVIDERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

THIS INCLUDES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMS ARISING FROM:

• PADDLING ACTIVITIES
• WATER CONDITIONS
• WEATHER
• LAUNCH CONDITIONS
• PROPERTY ACCESS
• USER-GENERATED INFORMATION
• MAP OR LOCATION INFORMATION
• GROUP TRIPS
• INTERACTIONS WITH OTHER USERS
• THIRD-PARTY SERVICES
• LOSS OF DATA
• SERVICE INTERRUPTION

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

By using information obtained through Let's Go Paddle to participate in paddling or outdoor activities, you acknowledge that those activities may involve risks that cannot be eliminated.

You are responsible for deciding whether to participate.

You voluntarily assume the ordinary and inherent risks associated with the activities you choose to undertake.

This provision does not waive rights or liabilities that cannot legally be waived under applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Let's Go Paddle and its owners, operators, affiliates, employees, agents, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from:

• Your violation of these Terms
• Your unlawful use of the Service
• User Content you submit
• Your infringement of another person's rights
• Your fraudulent or intentional misconduct
• Your organization or commercial operation of an activity through the Service

This provision applies only to the extent permitted by applicable law.

Unless specifically authorized by Let's Go Paddle, the Service is intended primarily as a paddling information and community platform.

Professional guides, outfitters, rental companies, instructors, event organizers, or other commercial operators may be subject to additional requirements.

The ability to create a post, profile, or group trip does not constitute authorization, licensing, certification, or endorsement by Let's Go Paddle.

Commercial operators remain solely responsible for applicable:

• Business licenses
• Permits
• Insurance
• Certifications
• Taxes
• Safety requirements
• Employment laws
• Land-use requirements
• Other legal obligations

Users are responsible for their interactions with other users.

Let's Go Paddle is not obligated to mediate private disputes between users.

We may take action when a dispute involves violation of these Terms or presents a safety or security concern.

To the extent permitted by applicable law, these Terms shall be governed by and interpreted according to the laws of the State of Arkansas, without regard to conflict-of-law principles.

Nothing in this section eliminates consumer rights that cannot legally be waived under the law applicable to a particular user.

To the extent permitted by applicable law, legal proceedings arising from these Terms or the Service that are not otherwise subject to a legally required venue shall be brought in an appropriate state or federal court located in Arkansas.

The parties consent to the jurisdiction of those courts to the extent permitted by law.

Let's Go Paddle may update these Terms as the Service changes or legal requirements evolve.

When these Terms are updated, we will revise the Last Updated date.

For material changes, we may provide additional notice or require renewed acceptance when appropriate.

Continued use of the Service after updated Terms become effective constitutes acceptance to the extent permitted by applicable law.

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.

An invalid provision shall be interpreted or limited, where legally permissible, in a manner that most closely reflects its intended lawful purpose.

Failure by Let's Go Paddle to enforce a provision of these Terms does not waive our right to enforce that provision later.

These Terms, together with the Privacy Policy and any additional terms expressly applicable to particular features, constitute the agreement between you and Let's Go Paddle regarding use of the Service.
